Your Rights Under the Employment Standards Act, 2000
The Province of Ontario’s Ministry of Labour, Training and Skills Development is key agency mandated to set, communicate and enforce workplace standards, through its key areas of occupational health and safety, employment rights and responsibilities, and labour relations.
The Ministry is also the agency which implements the provisions of the two major labour laws in the Province of Ontario that are applicable to Filipino workers, as follows:
- The Employment Standards Act (ESA) which is an Act of the Legislative Assembly of Ontario. It regulates employment in the Province of Ontario, including wages, maximum work hours, overtime, vacation, and leaves of absence. The law protects workers’ rights. This law tells employers how to treat workers fairly. ESA protects most workers in Ontario. It does not apply to workers in federally-regulated industries, such as banks and transportation.
- The Employment Protection for Foreign Nationals Act, 2009 (EPFNA) applies to foreign nationals who work or are seeking for work in Ontario pursuan to an immigration or foreign temporary employee program.
